If we get a valid authorization, your card issuer will hold this value expecting a charge from us. Receipt of your credit card details and debit of payments does not constitute our acceptance of your order.
Notice to Credit Card Users: By submitting your order
3.1 An authorization for your transaction will be placed on the credit card you provided to Gardensouq (“Card”) and upon completion of your transaction, the total transaction amount will be settled against the authorization in accordance with your banking institution’s policies.
3.2 You authorize Gardensouq to charge the Card all amounts owed under the transaction, including deposits. You further authorize Gardensouq to re-initiate any charge on your Card that is dishonored for any reason.

We will not be liable to you for any losses caused as a result of unauthorized access to the personal and transactional information you provide to us when placing an order.
All figures displayed on this website relating to fees, charges, and any other amounts are in UAE Dirhams (unless otherwise stated) and are current at the time of issue but may change at any time. We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Our acceptance of your order brings into existence a legally binding contract between us. With respect to items sold by Gardensouq, we cannot confirm the price of an item until you order. Despite our best efforts, a small number of the items in our catalog may be misprinted/mispriced. If the correct price of an item sold by Gardensouq is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation. Other merchants may follow different policies in the event of a misprinted/mispriced item.

We reserve the right to correct errors at any time. All prices quoted are payable in UAE Dirhams and, unless otherwise stated, do not include VAT. You may be required to pay extra for delivery, and it might not be possible for us to deliver to some locations. Our delivery charges are specified when you place your order. We reserve the right to refuse to accept your order for any reason including without limitation and whether or not payment has been received by us if:
Our right to refuse your order
1.1 We have insufficient stock to deliver the goods you have ordered;
1.2 We do not deliver to your area;
1.3 One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers;
1.4 If we do refuse your order, we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
Your right to cancel your contract
2.1 You may cancel your contract with us for the goods you order at any time up to the end of the 24 hours starting from the day you received the ordered goods. Please note that under the distance selling rules, perishable goods like flowers, PPE masks, and food cannot be canceled after delivery.

2.3 If you have received the goods before you cancel your contract then you must send the goods back to our contact address at your own cost and risk. If you cancel your contract but we have already processed the goods for delivery you must not unpack the goods when they are received by you and you must send the goods back to us at our contact address at your own cost and risk as soon as possible. We strongly recommend the use of a courier or other ‘signed for’ postage method to return the goods. 2.4 Once you have notified us that you are canceling your contract, any sum debited to us from your credit card will be re-credited to your account as soon as possible and in any event within 30 days of your order.
2.5 If you cancel the contract but do not return the goods to us in the condition they were in when delivered to you or do not pay the costs incurred on your behalf, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.

Delivery of Goods
We will deliver the product(s) ordered by you to the address you give us for delivery at the time you make your order. Delivery will be made as soon as possible after your order is accepted and in any event within 7 days of your order or in the case of specified delivery date on that date.
You will become the owner of the product(s) you have ordered when they have been delivered to you. Once the product(s) have been delivered to you, they will be held at your own risk and we will not be liable for their loss or destruction.
Delivery of Incorrect Items
If we have sent you an incorrect product(s), please notify our Customer Services Department on telephone number +971 52 203 6798 or email us on [email protected] as soon as possible and we will arrange a pickup of the product(s) [and a refund will be provided]. If you would like us to replace the incorrect product(s) with the product(s) that you ordered, we will send you the correct product(s) as soon as possible.
We will reimburse any reasonable delivery costs you incur in returning the following product(s) to us: – product(s) we delivered to you in error; or – product(s) that you can prove were damaged upon delivery or are defective or incorrect.
Until you return such product(s) to us you are responsible for their safekeeping and taking reasonable care of them.

- Make good any shortage or non-delivery;

Save as precluded by law and except where you are dealing as a consumer, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the product(s) in question under clause above.
Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
Change of Delivery Date for Perishables
Change of delivery date for the perishable product(s), including but not limited to fresh flowers and plants must be received 24-hours in advance of dispatch of the product(s). Any change request received with less than a 24-hour notice will in certain circumstances result in up to an additional 50% charge on the perishable product(s) ordered.
RETURN AND EXCHANGE POLICY
At GardenSouq.com, we take pride in delivering high-quality products to our customers. In the rare event, however, that you receive a defective or incorrect product, we have a returns policy in place.
- Products may only be returned either at the time of delivery, or within 24 hours of the delivery.
- If you notice any issues with your product at the time of delivery, our delivery driver will process the return on the spot.
- In case you recognize an issue after our delivery driver leaves your address, you have 24 hours to return the product back to our store.
- Non-perishable goods may be exchanged within three days, provided they are in their original packaging and condition, free from damage and have not been used.
- Perishable goods such as plants can not be exchanged beyond 24 hours to ensure quality standards.
- If you realize there is an issue after our delivery driver leaves your address, you have 24 hours to return the product to our shop, please contact us for further details.
- Please note that our delivery driver will not come to your address for any returns pickup service.
- Any customization services or custom products provided at your request are not returnable nor exchangeable.
- Any online payments made by bank/card will take the standard 15 days of processing time by your bank for the full refund.
Please note that we do not offer returns or exchanges on clearance items, custom orders, or items that have been used or damaged by the customer.

AVAILABILITY AND SUBSTITUTIONS POLICY
The acceptance of all the orders is subject to availability. If for any reason the Product you ordered is no longer available, we will contact you using the contact details you supplied when placing your order and either:
- Offer you an alternative product of equivalent quality and price if this is possible, or
- Cancel the order and provide you a full refund in respect of that product.
If we are unable to contact you or do not receive a response from you, we will process any remaining products on your order and refund you for the products we were unable to supply.

When you place an order to purchase Products using the Website this is an offer by you to us to purchase those Products. After you place an order, you will receive an email from us acknowledging that we have received your order. However, this does not imply the acceptance of the order.
